Trademarks :
A trademark is a sign that distinguishes your goods (products) or services from those of your competitors. Registering your trademark at the Benelux Office for Intellectual Property (BOIP) gives you the exclusive right to use the trademark for certain goods (products) and services within the Benelux, for a(n) (extendable) period of 10 years.

Search for a trademark:
The Trademarks Register contains all trademark applications and registrations that are valid in the Benelux countries. In addition to Benelux trademarks, this includes Community (i.e., European) trademarks and international trademarks which designate the Benelux.
In the Trademarks Register you can monitor the status of your own applications and registrations, and check out existing trademarks held by other parties.
NB:
If a trademark does not appear in the Trademarks Register, that does not automatically mean that it is available.
Other registers:
If you wish to know whether your trademark has also been registered outside the Benelux, various options are open to you. You can search in the World Intellectual Property Organization (WIPO) database, in the database of the Office for Harmonization in the Internal market (OHIM), in the database of the country in question or in TMView
TMView is a free online information instrument. The information held in TMView is provided by the official trademarks offices of the various European countries. They own the content and are responsible for keeping it up to date. Information held in the databases of OHIM and WIPO is also accessible via TMview. On the TMView website you can see which European countries currently make their data available via TMView.
Copies:
The Trademarks Register also serves as the official publication for Benelux trademarks. This means, among other things, that many authorities will accept copies from the Register as proof of your application or registration. You can produce a copy yourself (free of charge) by clicking on “Print”. If you still need a certified copy (for a charge), just click on “Order”.
Is my trademark still available?:
Before you start using your trademark or tradename and before you arrange for its protection it is, of course, a good idea to investigate which older trademarks already exist. You can do this in a number of different ways:
How can I search?:
You can carry out a (free) search yourself. The Trademarks Register contains all the filed and registered trademarks which are valid in the Benelux. This not only means Benelux trademarks but also Community Trademarks and international trademarks which designate the Benelux.
You can ask the Benelux Office for Intellectual Property (BOIP) to search for you (for a fee) and establish which older trademarks exist for certain goods or services which may be grounds for an objection to the trademark that you want to register. Within a period of around three weeks you will receive a examination report which has been compiled using certain search criteria for word and image elements.
In this way, an indication can be given as to which trademarks are already registered. However, it can never be guaranteed that you will not get into a conflict with a third party. In the first place, rights other than those associated with registered older trademarks can cause problems. This applies particularly to trade names but also, for example, to copyrights or design law. Moreover, it is difficult to predict who might object to your trademark on the basis of which trademark, and your chance of success depends on all the actual and legal circumstances of that particular case.
Do things yourself or get things done by others?:
You can hire a trademark agent or a lawyer specialised in intellectual property to do the examination. Specialist knowledge is required to carry out an examination and, more importantly, to interpret the results properly and estimate the risks. A lot of companies do not have the necessary specialist knowledge and it is therefore a good idea for them to seek assistance from an expert.
