Trademark:
A trademark is a sign that distinguishes your goods (products) or services from those of your competitors. Registering your trademark at the Benelux Office for Intellectual Property (BOIP) gives you the exclusive right to use the trademark for certain goods (products) and services within the Benelux, for a(n) (extendable) period of 10 years.

Register a trademark:
Apply directly online:
You can apply to register and protect a trademark by filing the brand name and/or logo online. You can also register a trade name or company name as a trademark.

The Benelux Office for Intellectual Property (BOIP) is the official body for trademark registration in the Benelux. A standard 10-year trademark application costs 240 euro. The procedure for definitive trademark registration takes about 3 months.If your trademark cannot be registered after all, the filing fees will not be refunded. You can also accelerate the registration of your trademark upon payment of an extra fee.

The registration is valid for a period of 10 years. Your trademark will be protected for the duration of this period. You can then renew your registration at the end of the 10-year period.To maintain the right to your trademark you need to use it actively.

Registering a trademark on paper:
You can also register your trade name, product name or logo as a trademark by filling out the paper form. The costs for a trademark application on paper are 15% higher than those of an online application. You can print out the form, along with the explanatory notes. Send the completed form to us by post or fax, or hand it in to us in person.

Why register?:
There are several advantages to registering a trademark:
** Your trademark will be published in the official Benelux Trademarks Register. You will receive a certificate of registration.
** A registered mark enables the owner to take trade mark infringement proceedings.
** You can make use of the ® symbol. It tells the world that you value and will protect your intellectual property rights. As such, those who wish to avoid trouble will also avoid using your trademark.
** A registered trademark can be sold or licensed. It represents value and potential revenue to your business.

What can the BOIP do?:
As the independent and impartial administrator of the register, the BOIP is only allowed to provide information. We can provide you with information on all procedural aspects relating to the registration of your trademarks. However, we are unable and are not permitted to provide you with tailor-made advice.

If you wish, you can arrange the registration of your trademarks yourself. We have done everything possible to make the registration procedure as straightforward as possible. However, you should not forget that all kinds of practical and legal issues play a role in providing optimal protection of your trademarks.

The protection of trademarks and other IP rights is a specialist field and a lot of companies do not have access to the necessary competencies. It may therefore be a good idea to leave the matter to a trademark agent or specialised lawyer.

Fees trademark application:
Applying online for a trademark in the Benelux in three classes costs € 240. An application on paper costs € 276. The amount due must be paid into our bank account within a month of the application date. If we have not received your payment within this term, the filing date will be extended until the moment your payment is received.

Please be aware that if you trademark is not registered – due to or a refusal or an opposition for instance – you will not be reimbursed for the application costs incurred.
