Certificate Confirming the Property Rights

What type of information is stored at the National Archive of Georgia?:
** Information related to property rights from province notary control and funds of municipal governments on sale/purchasing of real-estate, architecture plans of buildings/constructions

And Property listed on individuals (including confiscation, exchange, gift, inheritance, purchase, order of the architect, architectural plans of the property, etc.) for the period of 1835-1921for Tbilisi and 1868-1999 for Kutaisi municipalities.
** State and governmental decrees on assignation of land to different agencies and/or organizations and on property listed on individuals for the period of 1921-2000;
** Information of registry, produced by local self-governments, courts and tax agencies.

When might I need to solicit a certificate on my property rights preserved at the National Archive?:
This certificate will assist you in assertion of the property.

When might I need to solicit information from the registry, produced by local self-governments, courts and tax agencies?:
This information will help you to define the decisions of executive committee, bylaws of the cooperatives, protocols of the board meetings.

Who should I address to obtain a certificate confirming my property rights stored at National Archive?:
To receive information stored at the National Archive, you need to refer to the Justice House and submit following documentation:
** ID card;
** In case of a legal person – written statement of a director or his deputy on organization’s title paper (if such exists);
** Power of attorney (in case of representation);
** Certificate of war veteran (if you wish to be served free of charge);
** IDP card (if you wish to be served free of charge);
** In case if you are parent of 4 or more children, ID cards of children (if you wish to be served free of charge);
** Certificate of a socially helpless person (if you wish to be served free of charge);
** Disability card of 1st or 2nd category (if you wish to be served free of charge);
** Pension card (for 50% exemption from state duty and only under condition that the document required from the archive is of an applicant).

Terms of service and the state duty:
For certificate confirming property rights:
On 10th day of application – 42 GEL
On 5th day of application – 58 GEL
On 3rd day of application – 67 GEL
Within 24 hours -75 GEL
On the day of application – 84GEL

For information from the registry, produced by local self-governments, courts and tax agencies:
On 10th day of application – 9 GEL
On 5th day of application – 12 GEL
On 3rd day of application – 14 GEL
Within 24 hours -16 GEL
On the day of application – 18 GEL

Security :
Intangible property of a debtor or third person which is transferrable to other persons might be used as security as for pecuniary as non-pecuniary claim so that a creditor (mortgagee) acquires the right to satisfy its claim by realization of the mortgaged property (a mortgage subject) or under the agreement between the parties – by accepting it in his/her ownership in case of failure in or improper execution of the liabilities.

A mortgagee has the preferential right to satisfy his/her claims in comparison with other creditors. Only upon registration of such right at the registry, the above mentioned security interest shall originate.
