Issuing of Ordinary Electronic Passport :

The ordinary electronic passport is issued, upon request, to Romanian citizens who comply with the conditions provided by the Law no. 248/2005 and is not under the incidence of any of the situations when the right to travel abroad is suspended (art. 15 par. 1 and 8 of the Law no. 248/2005 pertaining to the Romanian citizens’ regime of free traveling abroad).

Romanian citizens can only hold one valid ordinary/electronic passport and, only in the cases provided by the art. 17^1 par. (1) lett. b)-d) of the Law no. 248/2005, they can hold in the same time, a temporary passport as well.

Ordinary electronic passports are issued to underage Romanian citizens who do not find themselves under the incidence of a case of suspending the exercise of the right to the free traveling abroad under the following conditions:
a) in case of the child under the age of 14 only upon the request of both parents, of the surviving parent, of the parent who holds the custody granted by a definitive and irrevocable Court decision or, as the case may be, of the legal representative;
b) in case of the child between 14 an 18, upon his/her request, only with the approval of both parents, of the surviving parent, of the parent who holds the custody granted by a definitive and irrevocable Court decision or, as the case may be, of the legal representative.

The issuing of an ordinary electronic passport for an underage person in case of disputes between parents regarding the approval or in case one of the parents cannot express his/her will, save for the cases provided by the art. 17^1 par. (1) lett. e), is made only subsequently to the settling of disputes by the Court of law which rules according to the law.

During the period when the exercise of the right to travel abroad is suspended, the issuing of a travel document to Romanian citizens by the competent authorities is temporary refused and, if such document was already issued it can be withdrawn by the authorities competent to enforce such measure.

Note:
According to the art. 20 par. 5 of the Law no. 248/2005, “within 5 days as from the date when the Romanian citizenship is lost under the conditions of the law, the holder of an ordinary passport, electronic ordinary passport or the temporary ordinary passport or, as the case may be, the underage person’s parents or legal representatives are liable to hand over the travel document when in the country to any public community service for ordinary passports issuing and records or to the Passports General Directorate headquarters, and when abroad, to any of Romania’s diplomatic missions and consular offices”

Lodging An Application For Issuing The Ordinary Electronic Passport:
The applications for issuing ordinary electronic passports are lodged by the applicant in person, when in the country, at the public community services for electronic passports issuing and records in the territorial range of which they hold their domicile or, as the case may be, their residence, and when abroad, at Romania’s diplomatic missions and consular offices (art. 15 par. 8 corroborated with par. 2 of the Law no. 248/2005).

In case when, for objective reasons, the applicant for ordinary electronic passport cannot come to the public community service for passports issuing and records of his/her domicile or residence, the applications for issuing the ordinary electronic passports can be lodged with the nearest passports service(art. 15 par. 9 corroborated with par. 3 of the Law no. 248/2005).

Delay For Issuing The Ordinary Electronic Passport:
The applications are solved by the competent authorities in delays that flow as from the date of their lodging; such delays cannot exceed:
30 working days in case of applications for the issuing of ordinary electronic passports lodged in the country;
90 working days in case of applications for the issuing of ordinary electronic passports lodged abroad.

Note:
Presently the delay for electronic passports issuing was reduced to 14 calendar days for applications lodged in the country.

Documents Necessay For The Issuing Of The Ordinary Electronic Passport:
A) În Case Of Persons With Domicile În România:
** the identity card, the temporary identity card or, as the case may be, the identity bulletin. Such documents must be valid and provided in original. The temporary identity card must be accompanied by the birth certificate, in original;
** the proof of passports fees payment, in original;
** the prior passport, in original, if any.

Note:
** the documents must be lodged by the applicant in person;
** upon the lodging of the application, the applicant’s fingerprints and facial image are taken (persons for whom the taking of fingerprints is physically impossible are exempted from this obligation).

B) Documents Necessary For Issuing Of The Ordinary Electronic Passport In Case Of Children Under The Age Of 14 With Domicile In Romania:
** the child’s birth certificate, in original;
** identity documents of both parents or of one parent, of the legal representative or, as the case may be, of the empowered person. All such documents must be valid and provided in original;
** the proof of passport fees payment, in original;
** as the case may be, special power of attorney or the declaration of consent of the other parent in original, the definitive and irrevocable Court decision for the child’s custody, the definitive and irrevocable Court order which replaces the other parent’s consent or, for applications lodged by the surviving parent or by the person empowered by the same, the death certificate of the other parent, in original;
** documents issued by the institution that organizes the courses or the contest, documents issued or approved by a Romanian administrative authority competent in the field or, as the case may be, documents issued or endorsed by a Romanian medical authority, evidencing the period of time and the state or states where the courses will be kept, the contests will take place or the medical treatment will be carried out, solely for the applications lodged by the parent mentioned by the art. 7 par. 1 lett. e) of the Government Decision no. 94/2006 for the approval of the Methodological norms for enforcement of the Law no. 248/2005, as subsequently amended and supplemented, or for the applications lodged by the person empowered by this parent, under the art. 7 par. 1 lett. h) of the same enactment, in original;
** the child’s prior passport, if any.

Note:
** the child must be present upon the lodging of the documents;
** the documents are lodged by the parents/parent/legal representative/empowered person;
** the child’s fingerprints and facial image are taken upon the lodging of the application (children under the age of 12 are exempted from the obligation of giving their fingerprints);

The declarations or, as the case may be, the special powers of attorney authenticated by the foreign authorities shall be accompanied by the authorized translation and they must comply with the following conditions in order to be used in front of the foreign authorities.
1.documents issued by the authorities of the states signatories of the Hague Convention abolishing the requirement for legalization for foreign public documents of October 5, 1961, to which Romania adhered by the Government 2.Ordinance no. 66/1999 approved by the Law no. 52/2000 as subsequently amended, must be apostilled;
3.documents issued by the authorities of the states that Romania has concluded treaty of judicial assistance with are exempted from the legalization, apostil or any other formality, according to the provisions contained by the said treaties;
4.documents that are not included in the above-mentioned categories must be legalized in the conditions provided by the art. 62 of the Law no. 105/1992 pertaining to the regulation of the private international law procedures.

Court decisions given abroad must fulfill the conditions provided by the law for being recognized and enforced

C) Documents Necessary For Issuing Of The Ordinary Electronic Passport In Case Of Children Between The Age Of 14 And 18 With Domicile In Romania.:
** the child’s identity card or, as the case may be, the temporary identity card, valid documents in original. The temporary identity card as well as the new identity card (which does not include the parent’s first names) must be accompanied by the birth certificate in original;
** declarations of consent of the parents/parent/legal representative (for underage persons who are legally married such declarations are no longer necessary); in case only one parent’s consent is provided, the application must be accompanied by: a) Court decision granting the child’s custody or replacing the other parent’s consent, both being definitive and irrevocable, b) the other parent’s death certificate or c) documents issued by the institution that organizes the courses or the contest, documents issued or approved by a Romanian administrative authority competent in the field or, as the case may be, documents issued or endorsed by a Romanian medical authority, evidencing the period of time and the state or states where the courses will be kept, the contests will take place or the medical treatment will be carried out, in original;
** the proof of passport fees payment, in original;
** the child’s prior passport, if any.

Note:
** documents must be lodged by the child in person, his/her presence in front of the passport officer being compulsory;
** upon the lodging of the application the applicant’s fingerprints and facial image are taken (are exempted from the obligation to give their fingerprints the persons whose fingerprinting is physically impossible);
** the ordinary electronic passport is issued upon the child’s request only with the consent of both parents, of the surviving parent, of the parent who has the child’s custody granted by definitive and irrevocable Court decision or, as the case may be, the consent of the legal representative.
** declarations of consent for the child’s passport issuing are given in front of the passports officer who is taking over the application, case when the identity documents of both parents, of one parent or of the legal representative, in original, must be provided;
** declarations pertaining to the consent for issuing a child’s passport given in different conditions than those provided above must be authenticated, when in the country by the public notary, and abroad by Romania’s diplomatic missions or consular offices or by the foreign authorities, case when the provisions of the art. 9 par. 7 of the Government Decision no. 94/2006 for the approval of the Methodological norms for enforcing the Law no. 248/2005, as subsequently amended and supplemented, must be enforced;
** Court decisions given abroad must fulfill the conditions provided by the law for being recognized and enforced.

Collecting The Ordinary Electronic Passport:
The ordinary electronic passport is collected from the public community service or, as the case may be, from Romania’s diplomatic missions and consular offices abroad by the holder personally, by the person who filed the application or by the person empowered by special power of attorney complying with the conditions provided by the art. 9 of the Government Decision no. 94/2006 for the approval of the Methodological norms for enforcement of the Law no. 248/2005, as subsequently amended and supplemented.

Note:
At the moment of lodging the application the applicant must make the mention of which public community service for passports issuing and records or diplomatic mission or consular office he/she wants the passport to be provided for being handed to them.
