Registration of Rental on Immovable Property :

Immovable property (real estate):
According to Civil Code of Georgia immovable property (real estate) is defined as a tract of land with its subsoil minerals, the plants growing on the land, and buildings and other structures firmly attached to the land.

In accordance with the law of Georgian on Public registry for the purposes of its registration immovable thing is defines as a tract of land with or without buildings and other structures attached to the land, buildings (under construction or already constructed or destroyed), units of building (under construction or already constructed or destroyed) and linear constructions.

Rental:
Under a rental contract the lessor is bound to transfer the thing to the use of the lessee for a specified period of time. The lessee is obligated to pay to the lessor the stipulated rent.

What is the registration of rental on immovable property?:
Immovable thing may be transferred to lessee for the use for a specific period of time. The lessee is obligated to pay to the lessor the stipulated rent. The lessee is entitled to use the property only upon registration of rental.

When does it become necessary to register rental on immovable property?:
It becomes necessary to register the right to rental at the public registry, only if the party to this transaction is a legal person of private law (LTD, cooperative, JSC, etc). In any other circumstance the registration of such right is unnecessary.

Where should I apply to register rental on the immovable property?:
To register rental on the immovable property, please refer to the Public Service Hall and submit following documentation:
1. Application (to be filled by front office operator);
2. A copy of your ID card;
3. A duly authorized (by notary or by public registry) document, verifying the commencement of the right to rental;
4. A receipt of payment of state duty (payment may be done on spot).

If you are a legal representative of an interested party than, additionally, you need to submit an authorized power of attorney and a copy of your ID card.

On case by case basis, additional documentation or information may be requested to make a decision on given case.

The term begins on the second day of registration and ends on the last day of the term. If the last day of the term coincides with holidays or weekends, than the last day of the term is the following business day.

Simple written transaction concluded before December 10, 2010 may be the ground of registration of the right to rental on immovable property.

Terms of service and the state duty:
In 4 business days:50 GEL
In 1 business day:150 GEL
On the day of application:200 GE

Note:
In accordance with Georgian legislation, if the owner of the right to rental is the state, self-government and National Bank of Georgia, this service is free of charge.
