Political Party Registration :

** Must be incorporated under the Associations Incorporation Act (provide certificate of incorporation)
** Written party constitution (also provide electronic copy)

** Minimum of 500 financial members
** K10,000.00 registration fee (nonrefundable) (Bank Cheque to Central Fund Board of Management)
** Open to a public objection process

Registration Process:
Party lodges an application, including K 10,000.00 fee
** The Registrar carries out checks
** When all requirements are satisfied the Registrar advertises the application (newspaper for three weeks)
** Allow for any objections to the party being registered
** The party has a right of reply
** The Integrity of Political Parties & Candidates Commission makes a decision
** The decision may be appealed

Compliance:
The Organic Law was passed by Parliament to enforce Section of the Costitution
As a legislation that intends to regulate the activities of the political parties, the parties must comply with relevant provisions of the Organic Law
Compliance means to obey or to strictly adhere to the Organic Law

The Organic Law on Integrity of Political Parties and Candidates Commission:
The intentions of the Organic Law is very clear;
** To provide an environment that is stable – political stability
** One important element of political stability is the strengthening of political parties. This is the most important intention of the Organic Law.
** To enhance political integrity – protection of election from outside and undue influence
** Parties must have copies of the Organic Law

Specific Provisions:
1.Sections 24 to 28 – Political Parties General:
** Membership
** Executives
** Public Officers
** Requirement to register
** Qualification for registration

2. Section 29 to 35 – Registration Procedures
3. Section 52 – Amalgamation
4. Section 54 – Double Endorsement By a party
5. Section 55 Misrepresentation by a candidate
6. Section 56 – Political Party endorsed candidates
7. Section 74 – Interference with a MP
8. Section 79 – Contribution from Citizens
9. Section 80 – Contributions from International Organisations
10. Section 82 – Distribution of Funds
After complying with Section 83 and 88
11. Section 85 (3)(c) – Membership of a MP in a registered political party
Membership of a political party for 6 months or more

12. Section 87 – Contributions
Offence for making contribution beyond the accepted amount as stated under Section 79 (2)

13. Section 88 – Financial Returns by Political Parties
3 months after the date of the return of writs
Every 12 months thereafter

14. Section 89 – Financial Returns by Successful Candidates
3 months after the date of the return of writs
In a court of disputed returns, 3 months after the date of the return of writ following a byelection

15. Section 90 – False and Defective Returns

16. Section 91 Inspections:
** Compliance is very important in order to make the Organic Law effective
** IPPCC demanding compliance from parties is to establish a system that is workable
** Increase level of legitimacy and respect in the system
** Party officials must ensure that what is required from them must be delivered – it is their responsibility
