JPN Updating of Marriage Records

This is a submission to the Registrar-General for updating a personal marriage record regarding decree of divorce or annulment granted by high court.

Application Conditions

Updates to the marriage records related to divorce or annulment can be done only at the counters of the National Registration Department headquarters in Putrajaya or by post addressed to:
Ketua Pengarah
Jabatan Pendaftaran Negara
(Bahagian Perkahwinan dan Perceraian)
No. 20, Persiaran Perdana

Required Documents

** MyKad (photocopy of MyKad if application is by post).
** ORIGINAL passport (photocopy of the pages with personal details if application is by post).
** Photocopy of Marriage Certificate.
** ORIGINAL decree nisi absolute (divorced certificate) or certified true copy by the respective court or pertinent court e-filing.

Note :
Applicants are advised to make photocopies of the decree nisi absolute (divorced certificate) for future personal use.

Non-Muslims Malaysian who registered their marriage under the laws of a foreign country and re-registered with the Malaysian Government (NRD or Malaysian Representative Office) afterwards, was divorced in foreign country an order from a Malaysian High Court is required to endorse the divorced before it can be registered at NRD.

4. Decree nisi absolute / order or certified true copy by the relevant court (ORIGINAL and photocopy)

FAQs

What if a marriage is not solemnised according to the provisions of the Law Reform (Marriage and Divorce) Act 1976?
A marriage that is not solemnised according to the provisions of the act is deemed to be INVALID. When the Law Reform (Marriage and Divorce) Act 1976 (Act 164) came into force on 1.3.1982, it became COMPULSORY for all monogamous non-Muslim marriages to be registered under the act.

What is a MONOGAMOUS MARRIAGE?
A monogamous marriage means that after the effective date of Act 164, a person who is lawfully married under any law cannot lawfully marry again with any other person during the continuance of such marriage, whether in Malaysia or in any other country..

What is the penalty for marrying more than one person?
Any person lawfully married under any law, religion, custom or usage who during the continuance of such marriage purports to contract a marriage shall be deemed to commit the offence of marrying again during the life-time of his/her spouse under Section 494 of the Penal Code.

Who may solemnise a marriage?
A marriage may be solemnised only by a Registrar of Marriages appointed under Act 164 at the National Registration Department of Malaysia and the Malaysian consulates or an Assistant Registrar of Marriages in a temple, church or association.

  1. I left marriage life in year 2012 and he has sent me letters for mutual together back in year 2012 but till now I am not sure whether he has taken lawyer or not. How to check whether I already get divorce or not.

  2. My wfe is in Malaysia. She took her passport with marriage certificate and all proof. I.could not find her address. How to apply divorce?
