Online Banking Subscription :

“Online Banking” is a service that enables the subscriber to consult all the accounts opened in his name at the Bank (the accounts details, the deposit and withdrawal operations pertaining to such accounts, their balances…).

The subscriber is aware that his account details and balances displayed by the “Online Banking” services may not disclose the transactions being currently carried out or in course of execution; hence the Bank does not guarantee the accuracy of the information available on the “Online Banking” services.

The Subscriber is also aware that the information and the balances are displayed by the “Online Banking” services for information only and thus are by no means binding to the Bank, and do not constitute evidence against it, therefore the Subscriber is not allowed to use them as allegation or submit them as evidence, and they are subject to changes without any prior notice from the Bank.

The Subscriber expressly agrees that only the books of the Bank have legal force between the two parties and shall be deemed duly given proof of the accuracy of the transactions and operations.

The “Online Banking” services enable the Subscriber to request check books. The delivery of such check books shall take place at one of the Bank’s branches preset by the Subscriber within his request. The “Online Banking” services also enable the Subscriber to transmit the instructions and transfer orders to the Bank for implementation, provided the following rules are respected upon execution:

Transfer orders can only be executed from and to the accounts of the Subscriber, meaning that no banking operation or any transfer operation from the Subscriber’s account to a third person’s account can be carried out.

The Bank has the discretionary right to set daily and/or per transaction limits for transfers and exchange operations and to change it without any prior notice. These limits may be consulted via the “Online Banking” services.

No banking transaction or any transfer operation via “Online Banking” services can be carried out unless the Subscriber’s account balance is sufficient in such a way as to allow him to carry out such transaction, or if the value of the transaction or the transfer remains within the ceiling preset by the Bank for the Subscriber’s account.

All instructions, requests and transfer orders transmitted by the Subscriber via the “Online Banking” services are final and shall definitely commit the Subscriber.

The execution by the Bank of the instructions received via “Online Banking” services constitutes an evidence of the existence and the certainty of such instructions. Therefore the Subscriber accepts henceforth that the Bank doesn’t issue advices evidencing the execution of such instructions.

The Bank has the discretionary right to refuse or cancel any transaction requested via “Online Banking” mainly if it has any suspicion as to the identity of the person who has given the instructions or has requested the information or if it considers the request or the instructions incomplete or incorrect or contrary to laws, customs and rules.

With conformity to the provisions of Article /6/ below, the banking operations are executed on the same day they were instructed if such instructions are given on a working day and within the Bank’s working hours. However, in case the instructions are received outside working hours or during public holidays or closing day, the transaction shall be carried out on the first working day following the receipt of the said instruction. In addition, the operations pertaining to exchange transactions shall be carried out at the rate that is applied by the Bank at the date of execution.

All the above shall be carried out within the terms and conditions stipulated in the present contract, and according to the provisions of contracts and agreements previously signed by the Subscriber and that remain in force except for those which contradict the terms and conditions of the present contract.
