Military Pension Scheme :

The military pension scheme defined the cases in which a military person is entitled to receive a military pension as follows:
** Reaching the age defined to be duly referred to pension subject to passing the probation year.

** The person whose service is ended and has an actual military service term calculated of not less than eighteen years or whose actual military and civil service reached twenty years saving that actual service term may not be less than eight years.
** The person who is referred to early pension upon his request saving that such person shall have a service of not less than 15 years of which 8 years were in military service subject to the approval of the concerned minister.
** The person whose service is ended for the benefit of work as per the regulations of military service and with a service of not less than fifteen years saving that the actual military service may not be less than eight years provided that service termination shall not be due to absenteeism or disciplinary sentence or service is duly terminated for committing a crime.
** The person deceased (due to reason other than work) or whose service is terminated due to lack of medical fitness.
** The person who gets partially disabled during and because of work.
** The person deceased during and because of work.
** The military person who gets wholly or partially disabled due to military operations or captivity.

Retirement Age:
Retirement age is specified according to the following:
Officers (except pilots):
** Lieutenant & first lieutenant- 44 years old
** Captain- 48 years old
** Major- 50 years old
** Lieutenant colonel- 52 years old
** Colonel- 54 years old
** Brigadier general- 56 years old
** Major general- 58 years old

Officers (pilots):
** Lieutenant & first lieutenant- 42 years old
** Captain- 46 years old
** Major- 48 years old
** Lieutenant colonel- 50 years old
** Colonel- 52 years old
** Brigadier general- 54 years old
** Major general- 56 years old

Lieutenant general and above- no specified age since retirement is by Royal Decree.

Non-commissioned officer:
** Soldier- 44 years old
** Corporal- 46 years old
** Warrant officer- 48 years old
** Sergeant & staff sergeant- 50 years old
** Sergeant major- 52 years old

Pensionable Service:
Terms of service calculated for the purpose of pension:
** The actual regular service in armed forces subject to fulfilling the pension revenues for the same.
** Civil regular service subject to fulfilling the pension revenues for the same.
** Secondment terms as per the regular conditions subject to fulfilling the pension revenues for the same.
** Additional service term in case of pension entitlement for the actual service subject to fulfilling the pension revenues for the same.
** Provisional retirement term subject to fulfilling the pension revenues for the same.

Terms Excluded from calculation for the purpose of retirement:
** Irregular service term.
** Absenteeism term without leave.
** Leave term without salary except for the sick leave and study leave after supplying subscription.
** Deprivation of salary term.
** Parts of months of the total service.

Pension Settlement :

** Pension shall be settled on basis of one – thirty fifth of the last fixed salary was being paid to the military person and shall be calculated as follows:
due pension = (Last Fixed Salary x service term in months) ÷ 420.
** Pension shall be settled in cases of death or disability due to reasons other than work on basis of allocating the retirement pension representing 70 % of the last fixed salary unless pension settlement as per mentioned above provides a higher pension.
** Pension shall be settled in case of partial disability during and because of work or due to weather conditions or environmental diseases in an entity where the retiree was ordered to work on basis of allocating a pension representing 80 % of the last fixed salary unless the settlement as per the manner stated in the first paragraph provides a higher pension.
** Pension shall be settled in cases of death or complete disability during and because of work or due to the weather conditions or environmental diseases in an entity where the retiree was ordered to work on basis of allocating a pension equivalent to the last fixed salary.
** Pension settlement in cases of death, injury due to military operations, captivity or during live – ammunition training or flight training, maritime training, being on operations, military movements or as a result of injury because of a service ordered during facing armed organizations or in firing during breaking into the vandals’ places or chasing smugglers as follows:
1. Settlement shall be performed in cases of death or suffering a complete disability on basis of allocating a retirement pension equivalent to the highest salary in ranks for the position directly over that of the retiree’s.
2. Settlement shall be performed in case of suffering a partial disability on basis of allocating a pension representing 80 % of the last category for the position directly over that of the retiree.

Lump Sum Settlement:
If a military person is not entitled to receive a pension for actual regular service, the military person shall be entitled to receive a lump sum (remuneration) to be paid once calculated as follows:
** First five years of service: (last fixed salary x term of service in months ÷ 12) x 1.
** Second five years of service: (last fixed salary x term of service in months ÷ 12) x 2.
** Remaining service term: (last fixed salary x term of service in months ÷ 12) x 3.

Provided that in case of service termination due to absenteeism, disciplinary reason or due to committing a crime and the person is not resolved to be deprived of remuneration, such person shall receive the remuneration calculated in the second manner for the whole term exceeding the first five years.

Pensioner’s Beneficiaries:
** In case of the pensioner’s death, the pensioner’s beneficiaries shall be entitled to receive an equal pension to be distributed to them equally if they are three or more. If the pensioner’s beneficiaries are two, they are entitled to receive 75 % of the pension and if there is one beneficiary of the pensioner, such single beneficiary shall be entitled to receive 50 % of the pension.
** Beneficiaries of the pensioner are: spouse, mother, father, son, daughter, grandson and granddaughter whose father died when the pensioner was alive, brother, sister, grandfather and grandmother. Except for spouse, son and daughter, the beneficiary person shall be dependent in terms of sustenance upon the pensioner upon the latter’s death.
** The pension due to males, sons, grandsons and brothers, shall be stopped when they are twenty one. However, pension shall continue for entitled beneficiaries in the following cases:
1. If the entitled beneficiary is a student in a secondary or high school or a recognized equivalent school provided that the student must be studying regularly. Accordingly, the pension shall be paid to such entitled beneficiary until the beneficiary is twenty six old or until the beneficiary’s graduation, whichever comes first.
2. In case the beneficiary suffers a complete deficit preventing from earning living saving that the same shall be under a resolution made by the concerned medical authority until the beneficiary recovers.
** As of the date of marriage contract, the pension of the wife, daughter and niece if they get married and the mother if gets married to other than the deceased’s father saving that the entitlement shall be returned to her if divorced or widowed. If the entitled wife was married at the time of the pensioner’s death, pension shall be redistributed supposing her entitlement at the time of death.
** Pension shall be stopped being paid to the pensioner or to the entitled beneficiaries if appointed in public sector or if they were appointed in public sector at the time of the pensioner’s death saving that the employee’s salary shall be equivalent to the pension or exceeding the same. However, if such salary is less than the pension, the difference shall be paid to the entitled.
** If the share of any beneficiary is nullified or stopped due any reason, it shall not be paid to the other beneficiaries saving that the share of any remaining beneficiary in all cases shall not be less than (50 %) of the pensioner’s pension. If such share is less than the same, the remaining beneficiaries shall be paid to the extent of such percentage and to be distributed to them equally. However, in case the stopped share is to be paid again, pension shall be distributed to the entitled beneficiaries as if such share was never stopped.
