Customs Declaration Submission Procedures:

Customs Clearing agents who are submitting import declarations may use the electronic Customs Clearing system (eCAS) to declare goods.

You may submit a declaration providing:
** The goods being declared are not prohibited under the Customs Laws of the Kingdom of Bahrain
** The goods are under one Bill of Lading/Airway Bill
** To be cleared at the same place (Custom Point)
** Supporting documents can be presented

Submitting Declarations Electronically:
When submitting customs declaration using the system, you must ensure that adhere to the following guidelines below:

Shipping Information:
** Ensure all shipping details provided are correct and accurate
** Ensure the correct Bill of Lading/Airway Bill reference number is provided
** Correct packing information is supplied, including quantities and units of measure
** Ensure the Consignee/Importer/Trader has a valid Commercial Registration (CR) issued by the Bahrain Ministry of Trade and Commerce for the goods being declared

Item Details:
** Ensure correct Harmonized Code (HS Code) classification is provided
** Correct Goods value and currency is provided

Please note: It is an offence to provide inaccurate or incomplete information on your Customs Declaration. Penalties may be applied at the discretion of Customs Affairs. These penalties may include Fines, withdrawal of Clearing License or Legal action.

Terms and Conditions for use of eCAS system:
1. Definitions:
“Bahrain Customs” means the directorate of Customs Affairs, which is an agency of the Ministry of Interior, Kingdom of Bahrain;
“Declaration” means the Customs Declaration Form required to be completed by law, by the importer/trader, or his representative describing the declared goods;
“CDF” means the Customs Declaration Form submitted electronically through eCAS;
“Clearing Agent” means the company and its appointed persons registered to submit declarations;
“eCAS” means the electronic system provided by Bahrain Customs to enable electronic submission of declarations by Clearing Agents and their representatives;

2. Registration of Clearing Agent:
2.1 The clearing agent shall be required to have a valid license and be registered with Bahrain Customs.
2.2 The clearing agent user may appoint additional representatives under their employment to submit customs declarations. These representatives must be registered with Bahrain Customs, and possess a valid Customs Clearing License issued by Bahrain Customs.
2.3 The Clearing agent shall inform Bahrain Customs immediately of any changes in registered particulars of the Clearing agent or his representative.
2.4 Only the Clearing agent or their authorized representative may submit declaration on behalf of the Importer/Trader. The clearing agent must ensure that all data provided on a CDF is accurate and complete before submission to Bahrain Customs. The clearing agent must also ensure that any supporting documents and permits are complete and accurate.
2.5 The Clearing agent is solely responsible for the security and confidentiality of the password associated with the user identification number (User Id) assigned by Bahrain Customs. The clearing agent shall not disclose their password and User Id to any other person, and prevent any unauthorized access to the system. He should regularly change the password to ensure security and confidentiality. Bahrain Customs will not accept defense for the Clearing agent to allege that their User Id and password were used without their knowledge, or that they did not consent to the declaration made.
2.6 It is the responsibility of the Clearing agent to inform their representative of these terms and conditions and to ensure that they comply with them.

3. CDF’s:
3.1 The clearing agent shall comply with all documentation procedures for the preparation, submission and processing of the declaration through eCAS.
3.2 CDF’s submitted through eCAS shall be accepted by Bahrain Customs for processing either as or for and on behalf of the importer/Trader, exporter, or owner of the goods.
3.3 The Clearing agent shall ensure that proper and adequate controls are implemented for the transmission and retrieval of the data from Bahrain Customs.
3.4 The Clearing agent shall be bound by all the terms and conditions governing the submission of declarations through eCAS.
3.5 The Clearing agent shall accept full responsibility for all transactions made and shall accept responsibility for all violations. Individual action could be taken against respective clearing agent and/or representative for any incorrect or false declaration made.
3.6 The Clearing agent may submit CDF’s on behalf of a third party. Before acting as a clearing agent for the third party, the clearing agent shall verify the identity of the third party including its authorized person, business registration and address. The clearing agent shall provide information pertaining to the third party to Bahrain Customs if there were any violations against the law and accept responsibility for all violations notwithstanding that action could be taken against the third party for any incorrect or false declaration made.
3.7 The Clearing agent shall record and make available to Bahrain Customs upon request, the name identity card, passport number, address and contact details of the person swho have given the instructions on the CDF.

4. Violations:
4.1 : If it is found that the Clearing agent has made a false or an incorrect declaration, or a declaration which is incomplete through omission of data, the Clearing agent may be guilty of an offence under Bahrain Customs Law and other relevant laws. In addition the Clearing agent’s license may revoked and access to eCAS denied.

5. General:
5.1 Bahrain Customs shall not be liable for any loss incurred whether as a result of system or computer breakdown or malfunction or for any other reason whatsoever. The Clearing agent shall indemnify Bahrain Customs for any loss or damage suffered by any third party caused by such breakdown in relation to their submission of CDF’s to the system.
5.2 Bahrain Customs reserves the right at any time to suspend or terminate the Clearing agent from submitting CDF’s through eCAS for customs processing without providing any reasons.
5.3 Bahrain Customs reserves the right to amend or modify any of the above terms and conditions at its discretion. When such amendments or modifications are made, they shall be communicated to the Clearing agent and shall be considered to be part of the terms and conditions and the Clearing agent shall be bound by them.
