2. All original documents must be submitted along with one copy of each document. Documents in a foreign language must be accompanied by certified translations by a translator approved by chambers.

3. Answer questions on application form honestly as all information provided is checked for veracity.

4. Dishonest answers and documents will prejudice your application. Additionally, should your dishonesty be discovered after your application has been approved, you naturalisation may be revoked.

5. Your application for naturalisation will not be considered unless:
(a)(i) you have had Belonger Status for at least one (1) year prior to your naturalisation application. If your Belonger Status is based on your marriage to a British Overseas Territories Citizen (BOTC) (Anguilla), the one-year waiting period does not apply; OR
(ii) you have had Permanent Resident Status for at least one (1) year immediately preceding the consideration of your application. For example, if Permanent Resident Status was granted to you on 12 April 2003, your application will not be considered unless that status had been renewed on 12 April 2004. Note that you should not submit an application for naturalisation close to the date of expiration of your Permanent Resident Status because if that status expires prior to the time that your application is being considered, you will be required to renew it;

AND (b)
(i) you have been resident in Anguilla for a period of five (5) years immediately preceding the date of the application; OR
(ii) if you are married to a BOTC (Anguilla) you have been resident in Anguilla for a period of three (3) years immediately preceding the date of the application.

6. The naturalisation process can take several months, if you are seeking to facilitate travel overseas, please submit your application way ahead of your intended date of departure. We aim to process applications within 20 months.

7. For those few persons to whom BOTC (Anguilla) passports were issued previously, but who are now required to be naturalised, you will not be required to pay the grant fee required for naturalisation, only the processing fee.

8. If you have any questions concerning your status and/or the need for you or your child to be naturalised or registered, respectively, please contact the Chambers for an assessment of your status. Each individual’s circumstance is unique.

9. Ensure that the section of the application form that requires you to list your absences from Anguilla is filled out in detail. We also request that you include any travel and any time spent off island including, for example, daytrips to St Martin / St Maarten. All travel must be listed in date order beginning with the oldest (ie. chronological order). This section will be utilized to determine whether you meet the residence requirements for naturalisation and will be checked to ensure the veracity of the information provided.

10. Applications for registration of children must be accompanied by school letters from ALL the schools they have attended in Anguilla.

11. Your application must be accompanied by letters from ALL your employers for the past five (5) years. If you are unemployed, you must submit a letter stating that you are unemployed and how you are maintained financially.

12. Where applications for registration are made for children who are born out of wedlock in Anguilla to BOTC (Anguilla) fathers, and mothers who are neither BOTC (Anguilla), Belongers nor Permanent Residents, these applications will not be considered unless—
a) the father’s name is on the child’s birth certificate; or
b) there is an affidavit\declaration of paternity by the father and an indication from the mother that this person is the father of her child.

Note: In future DNA testing may be required as proof of paternity.

13. The reference persons who are to sign the back of your naturalisation application form must be BOTCs (Anguilla) and must have known you for over five (5) years.

14. Applications from Dominican Republic nationals. Please note that due to the number of false documents emanating from this jurisdiction, depending on the basis of your application, your documents may be sent to the British Embassy in the Dominican Republic for verification of their authenticity. This may delay the application process. As above, all translations submitted must be produced by a translator approved by chambers.

15. All applicants for naturalisation are required to be interviewed at the Attorney General’s Chambers. We will inform you of the date and time of your interview via telephone. Please ensure that the contact number on your application form is correct.

16. Prior to and at your interview, you may be required to submit additional documents. Your compliance is essential to the processing of your application.

17. Applicants for naturalisation may be required to pass a language test to assess whether or not they are able to communicate in the English language effectively both in writing and orally. If your application for naturalisation has been deferred to a specific date, please contact the Chambers on that date, so that your application can be reactivated.
