Family Reunification :

You can benefit of the family reunification as citizen of a State outside the European Union and the European Economic Area only if you are the holder of a temporary residence permit, valid for one year, of an EU Blue Card, of a long term residence permit or if you benefit of the refugee or subsidiary protection status.

Romanian citizens can obtain family reunification, as well, the procedure being much simpler, in the sense that the family members can submit a direct application for the issuance of the long term residence visa, without the necessity to obtain the prior endorsement of the General Inspectorate for Immigration.

For whom can the family reunification be requested:
As sponsor, you can request the family reunification for your husband/wife, for your or your husband/wife’s single underage children, including for your adopted children and for those supported by you or by your husband/wife.

The family reunification can also be performed for your or your husband/wife’s ascendant relatives once removed, if unable to support themselves and if they lack adequate family support in their country of origin. Moreover, the family reunification can also be performed in the case of your or your husband/wife’s single adult children, if they are unable to support themselves for medical reasons.

If the parental rights, in relation to the underage child’s support, are jointly exerted by both parents, the consent of the other titular is necessary to be granted, when submitting the application for family reunification.

The family reunification can also be requested by unaccompanied underage children, benefiting of the refugee or subsidiary protection status, by ascendant relatives once removed or by the legal custodian, or in case other relatives thereof do not exist or cannot be identified.

Special cases:
If you are the holder of a residence permit for the performance of scientific research activities, or if you are the holder of an EU Blue Card, you may request the family reunification even if the residence permit expires within less than one year.

EU Blue Card holders, who, after 18 months of legal stay in the first member State, move to Romania in the purpose of being employed in a highly qualified position, may request the family reunification, for his/her family members, on condition the residence permit issued by the first member State is submitted.

Endorsement of the family reunification application:
The first step towards taking your family to Romania consists in obtaining the endorsement from the General Inspectorate for Immigration. For this, you must submit a series of documents to the territorial formations of the General Inspectorate for Immigration in your residence County.

Please find below a list with the respective documents:
a. application;
b. Marriage Certificate/Birth Certificate or, as the case may be, proof of kinship, issued by the competent authorities, translated and superlegalized or apostilled according to the law;
c. statement in original, according to which your family members will live with you;

d. copy of the document certifying your right of residence on the Romanian territory;
e. proof of the legal ownership of the living space representing the dwelling declared normal for a similar family in Romania;
f. proof of the means of subsistence;

g. proof of your recording in the social health insurance system;
h. written statement of the person holding, together with the sponsor, the joint custody of the underage child for whom the family reunification is requested, stating the consent in order for the underage child to live together with the sponsor on the Romanian territory;

The family reunification application is approved provided the following conditions are fulfilled:
a. the absence of bigamy or polygamy;
b. the applicant holds a dwelling space considered normal for a similar family in Romania;
c. the applicant holds means of subsistence, besides the necessary ones for his/her own subsistence, according to the law, equivalent to the national minimum net wage for each family member.

d. the person for whom the family reunification is requested must fulfil the following conditions:
** be the holder of a valid document for crossing the State border, which is acceptable for the Romanian State;
** not be included in the category of persons whose entrance in Romania is forbidden, or who are declared undesirable persons;
** is not a threat to the national defence and safety, to the public order, health or morality.

The settlement of the application will occur within at most 3 months since the date of submission thereof.

You will receive our response in writing, and if the application was approved, you will transmit the communication to your family members, who will submit it afterwards to the diplomatic mission or to the consular office, within 60 days since the date of issuance thereof, together with the application for the long term residence visa necessary for achieving the family reunification.

The next step concerns the granting of the long term residence visa for family reunification, issued by the Romanian diplomatic missions and consular offices in the State where your family members have their residence.

Family reunification for Romanian citizens :
Romanian citizens can also request family reunification, the first step no longer being necessary, meaning the endorsement of the application by the General Inspectorate for Immigration.

Thus, the family members of Romanian citizens will request directly from the Romanian diplomatic missions and consular offices in the State of their residence the long term residence visa for family reunification.

Persons who may request the long term residence visa as family member of a Romanian citizen

The following categories of persons may request the visa for family reunification:
** foreign citizens married with Romanian citizens;
** single foreign citizens, living with single Romanian citizens, if they have at least one child together, hereinafter referred to as partners;

** children of the Romanian citizen, of the husband/wife or partner thereof, including the adopted children, if they did not celebrate their 21st birthday yet or who are supported by the Romanian citizen, by the husband/wife or partner thereof;
** ascending relatives once removed of the Romanian citizen or of his/her husband/wife;

** the foreign citizen, as parent of the underage Romanian citizen, if he/she proves that the underage child is supported by him/her or that he/she has the obligation to pay alimony to the respective child, that the foreign citizen fulfils regularly;
** foreign citizens, family members of Romanian citizens, who make the proof of the registration of their residence right in another member State, in this quality.

The visa request for the family members of Romanian citizens will be accompanied by the Marriage Certificate issued by the Romanian authorities or transcribed according to the law, or, as the case may be, by the proof attesting kinship or partnership.

The applicants requesting the visa for the family members of Romanian citizens, who make the proof of the registration of their residence right in another member State, in this quality, will be accompanied by documents attesting the registration of their residence right in another member State, in the quality of family member of the respective Romanian citizen.

The granting of the long term residence visa for family reunification can be refused when the request is based on a fake marriage, ascertained at an earlier time, according to the conditions of the present Emergency Ordinance, or when the existence of the state of bigamy or polygamy is ascertained.
