Onshore – Protection Visa

Refugee and humanitarian :
** The onshore component of the Refugee and Humanitarian program aims to provide options for people who are in Australia and wish to apply for protection (or asylum).

** Australia has three types of protection visas available for people onshore who wish want to apply for protection.

Protection visa (subclass 866) :
Features :
** This visa allows you to live and work in Australia as a permanent resident.

Requirements :
You might be able to get this visa if you :
** are in Australia and you engage Australia’s protection obligations
** did not arrive in Australia as an illegal maritime arrival or unauthorised air arrival.

Temporary Protection visa (subclass 785) :
Features :
This visa allows you to :
** stay in Australia for up to three years
** work
** study.

Requirements :
You might be eligible for this visa if :
** you arrived in Australia illegally
** you are invited to apply for a Temporary Protection visa
** you lodged a valid Form 866 – Application for a protection visa
** you are assessed as engaging Australia’s protection obligations
** you meet other requirements, such as health, security, character and identity checks.

Safe Haven Enterprise visa (subclass 790) :
Features :
This visa allows you to :
** stay in Australia for five years
** work
** study
** apply for certain substantive visas if both the SHEV pathway and the substantive visa application requirements are met.

Requirements :
You might be eligible for this visa if :
** you arrived in Australia illegally
** you are invited to apply for a Safe Haven Enterprise visa
** you lodged a valid Form 790 – Application for a Safe Haven Enterprise visa
** you or a member of your family unit declares an intention to work and/or study in regional Australia
** you are assessed as engaging Australia’s protection obligations
** you meet other requirements such as heath, security, character and identity checks.

Fees and charges for visas :
** If you pay for your visa application by credit card, a surcharge will apply.

The current surcharge rates are:
** Visa and MasterCard* – 1.08%
** American Express and JCB – 1.99%
** Diners Club International – 2.91%
** The surcharge will also apply to debit cards when making payments online.
** The cost of visas changes from time to time.
** The cost of your visa is dependent on the date we receive your application.
** If there is a price increase between the date you lodge your application and the date we receive your application, you will need to pay the new application charge.
** The visa application charge is the amount of money in Australian dollars (AUD) that must be paid for a visa application. In some cases the visa application charge is nil.

How To Pay :
Paying for online applications :
** All online applications and services are charged in Australian dollars.

Acceptable payment methods are :
** MasterCard
** VISA
** American Express
** Diners Club
** JCB
** pre-paid credit cards
** BPAY.
** To use BPAY you must have an Australian bank account and you must be registered with the bank’s telephone or internet banking service.
** When paying by credit card in Australian dollars (AUD) you might incur banking and currency conversion fees and you will need to accept the risk associated with any currency fluctuations.
** A credit card surcharge will apply to transactions made using your credit card.

Paying for applications lodged in Australia :
Acceptable payment methods are :
** MasterCard
** VISA
** American Express
** Diners Club
** JCB
** pre-paid credit cards
** EFTPOS/debit card, in person only – available only for on the spot services such as visa evidencing
** bank cheque, made payable to Department of Immigration and Border Protection
** Australia Post only money order, made payable to Department of Immigration and Border Protection.

** In addition to the above payment methods, if you are outside Australia, you can pay by international money order made payable to Department of Immigration and Border Protection, and drawn on a bank with representation in Australia.

** Personal cheques are not accepted. Do not send cash through the post.
** A credit card surcharge will apply to transactions made using your credit card.
