The Hurley-DubYouth 10 Milli Remix Contest 2015:
Doggy House Records is hosting The Hurley-DubYouth 10 Milli Remix Contest in conjunction with 10 years anniversary of DubYouth. The Competition is to remix “Bababoom” the Artist’s new song featuring Masia One. The Start Date of the Competition is from 7th October 2015 and the Closing Date is 7th November 2015.
Prize:
Only 1 (one) of the top Remix according to the Judges will receive a grand total of Rp. 10.000.000 in cash and voucher from Hurley as the Promoter.
Rules:
Do not use the Stems for anything outside of this Competition. Do not enable downloads until after the deadline of Judging End Date, after then you are able to give the Remix away for free if you wish to do so.
Remix Parts and Submission Method:
The Remix pack and Master can be downloaded from Promoter SoundCloud or Direct Download. Completed remixes should be added to the Promoter SoundCloud group with downloads disabled. Please check our Terms and Conditions for further information.
Terms and Conditions of The Hurley-DubYouth 10 Milli Remix Contest:
1. Promoter:
This Competition (#10MilliRemixContest) is being run by Doggy House Records (“we”, “us”, “our”) of Yogyakarta, Indonesia. We are the “Promoter” of the Competition and the Republic of Indonesia is the host domain of the Artist Website (defined below). Sponsor in this Competition is backed up by Hurley.
2. Premise of Competition:
As detailed on DubYouth (“Artist”) website at www.dubyouth.com (the “Artist Website”), this competition invites you to create a remix (“Remix”) of the Artist recording entitled “Bababoom” (“Master”) and upload your Remix as part of the Competition via the official contest group at Soundcloud page: https://soundcloud.com/ (“Promoter Soundcloud”). The Judges (as defined below) shall select one (1) winner of the Competition in accordance with the process set out in these terms and conditions (the “T&Cs”).
3. Eligibility:
In order to enter this Competition you must be over 17 years old. If you are under the age of majority in your country of residence you may be asked to provide written confirmation of your parent or guardian’s permission to you entering the Competition. If you are the winner of the Competition we will definitely require this confirmation.
Our employees, directors, management, licensees and contractors and those of our related or associated companies and agencies, our retailers and/or our suppliers, and the immediate family of any such persons, are not permitted to enter the Competition.
4. Competition Dates:
The Competition commences on 7th October 2015 (the “Start Date”) and you must submit your Remix by 11:59 pm Indonesian time 7th November 2015 (the “Closing Date”). We accept no responsibility for lost, late, illegible, indistinct, incomplete or misdirected entries and such entries will not be submitted for the judging process.
5. How to Enter:
(a) Read the instructions on the Artist Website and Artist Soundcloud and download the audio stems of the Master (the “Stems”) from the contest group on the Promoter Soundcloud.
(b) Once you have completed your Remix, submit to the contest group at Promoter Soundcloud on or after the Start Date. Entries must be received by the time specified above on the Closing Date.
(c) Any remix that fails to meet the Remix Specifications may be disqualified.
(d) Proof of submitting a Remix does not constitute proof of receipt by us or Artist of the Remix nor proof or confirmation of entry into the Competition.
(e) Neither we, Artist or Soundcloud are responsible for malfunctions of electronic equipment, computer hardware or software, or any other technical problems related to entry submissions.
(f) Any attempt at entry except as stated above and within these T&Cs and any directions on the Artist Website and Artist Soundcloud is void.
(g) Our computer system will be the official clock of the Competition in determining the Start Date and the Closing Date.
(h) There is no limit on the number of Remixes that you may submit but each Remix must be submitted separately and will be judged as a separate, distinct entry. If you submit more than one Remix, each is called your Remix for the purpose of these T&Cs.
6. Remix Specifications:
In creating and submitting your Remix for and as part of the Competition, the following will apply (the “Remix Specifications”):
(a) The Remix must be a completely new recording made by you from the Stems, and you must ensure that the Remix (excluding the Stems) does not infringe the copyright, trademark, privacy, publicity or other intellectual property rights of any person or entity. It must not include recordings made or owned or music written or owned by anyone other than you, save for the Stems (which are owned by us).
(b) You must not allow anyone to feature in your Remix who you do not know, including (but not limited to) vocalists, musicians and instrumentalists. In respect of all “Performers” – being everyone who features in or performs on your Remix, or who otherwise assists you with any aspect of the creation of your Remix – you must obtain written consent to our ownership of and right to use your Remix as per paragraph 9 of these T&Cs. You are responsible for obtaining each Performer’s consent to these T&Cs and ensuring each Performer complies with the T&Cs.
(c) Your Remix must not contain any illegal, obscene, racist, defamatory or sexual material, any material likely to offend any person or any material likely to infringe any person’s rights of privacy.
7. Prize:
Only 1 (one) winner of the Competition will receive the prize, subject to these T&Cs.
The prize is:
A grand total of Rp. 10.000.000: Rp. 5.000.000 in cash and Rp. 5.000.000 in voucher from Hurley.
The winner is responsible for all applicable personal documentation and federal, state and local taxes, if any, relating to and/or payable in respect of the prize. The prize claim is subject to our verification. No prize substitutions or transfers allowed, except in our sole discretion. In the unlikely event that any portion of the prize is cancelled or undeliverable for any reason (including local government regulations), the winner agrees that we have no further obligations or liability to the winner other than delivery of the remainder of the prize, if possible.
8. Selection and Notification of Prize Winner:
(a) The winning Remix will be chosen based on the following equally weighted criteria:
Originality, creativity and musicality. Each submitted Remix will be reviewed by us and if deemed in our discretion to achieve a high level of originality, creativity and musicality, will go into the prize draw for review by a panel of judges including the Artist and Promoter (collectively the “Judges”). The Judges will review each such Remix again on the basis of originality, creativity and musicality. The Judges’ decision as to the winner is final.
(b) Prize winners will be notified by email on or before 7th November 2015 (the “Judging End Date”). We will not notify unsuccessful entries.
(c) The notified winner will have 48 hours from the moment such notification is issued to respond to such notification by following the instructions provided therein. At or following notification the winner will be provided with a “Release”, which confirms the winner’s personal details and the assignment of rights to Parlophone as detailed in these T&Cs. If the Release is not signed and returned within 5 (five) working days, in our discretion the prize may/shall be deemed forfeited and an alternate winner selected. Return of any prize notification directed to a potential winner, or subsequent Release document, as undeliverable will result in disqualification and selection of an alternate winner. Where the winner is under the age of majority in the winner’s country, the Release must be signed by the winner’s parent or guardian in order to be valid.
(d) If a potential winner does not reply to the notification(s) within the stated period(s), or does not return the signed Release, or such person’s reply is ineligible, or cannot or does not comply with these T&Cs, then in our discretion he/she will be disqualified, the prize will be forfeited and an alternate winner may be selected.
(e) The name of the winner will be confirmed on the Promoter, Artist Website and the Artist Soundcloud.
9. Ownership of Your Remix and Our Rights to Use Your Remix:
(a) You hereby agree and confirm that in consideration of your being given the chance to enter the Competition and have your Remix judged, and in consideration of having the opportunity to win the prize, we shall own your Remix from the date of creation and we shall have the exclusive right and entitlement to use and/or exploit Your Remix or authorise others to do so (or to choose not to utilise the Remix) without further reference or payment to you. For the purposes hereof, “Remix” shall include all edits, mixes, copies and/or versions of the Remix, to the extent of your involvement in and/or ownership of the same.
(b) In order to transfer to and confirm our ownership of and rights in the Remix:
(i) you hereby assign to us (including by way of present assignment of future copyright) any and all rights in your Remix with full title guarantee free from all encumbrances charges and liens and we (and our licensees and assignees) shall have the exclusive perpetual right to store, edit, mix, overdub, vary and otherwise alter the Remix, and to use, reproduce, copy, transmit, publish, post, display, exhibit, broadcast, perform, synchronise and/or exploit the Remix throughout the World (or not, as we see fit), and to authorise others so to do without further reference or payment to you or reference or payment to the Performers;
(ii) you hereby grant us all consents to enable us (or to enable any third party we may choose) to fully use and exploit your Remix, and you agree that your Remix may be used in connection with third party advertising, branding or endorsement or otherwise in our discretion and without limitation;
(iii) you irrevocably waive any right that you or the Performers may have to receive a credit in respect of your Remix or to stop us from changing or altering your Remix in any way we wish;
(iv) you agree to promptly sign all documents and/or undertake all reasonable steps to confirm our ownership of the Remix and rights herein, upon our request following completion of the Competition. Where required by us you will provide written confirmation by your guardian or parent of your right to enter into this Competition and acceptance of these T&Cs.
(c) You acknowledge and confirm that we are the sole owner of all rights including copyright in and/or to the Stems, and you have no rights in the same. Notwithstanding the foregoing we hereby confirm the grant to you of a non-exclusive limited licence to use the Stems to create your Remix solely for the purposes of this Competition. Any use whatsoever of the Stems (or any part thereof) beyond the Closing Date or other than as expressly stated herein will be a breach of these T&Cs and a breach of our copyright for which we will have a claim at law against you.
(d) You may be required to provide us with proof that you are the authorised account holder of the email address associated with your entry.
(e) Notwithstanding the general wording set out above, we shall not exploit your Remix if you are not the winner, save with your consent, and you agree not to unreasonably withhold or delay that consent. Where we use your Remix we will, where usual and practical, credit you for your contribution to such Remix by including words such as “remixed by [name]” or similar (in our reasonable discretion).
